Terms of Use

General Terms

  1. These Timo Murene (www.timomurene.euOnline Shop (hereinafter referred to as the E-shop) Terms of Use and Transaction Provisions (hereinafter referred to as the Terms) determine the procedure in accordance with which the Timo Murene E-shop is used, what procedure determines the conclusion of an agreement between the E-shop and the customer, the Terms of the relevant agreement and the manner of its execution, the timing and procedure for the exercise of the customer’s right of withdrawal.
  1. The E-shop is managed, and its transactions are concluded, by SIA RONAVI (registered office at Rīga, Grēdu iela 1-99, LV-1019, registration No. 40003965755) acting on its own behalf. SIA RONAVI is registered in the Republic of Latvia Register of Enterprises Value Added Tax Payer Registry under No. LV40003965755 and applies the European Union regime for applying value added tax.
  1. A distance agreement is considered concluded once SIA RONAVI receives payment for a transaction on its account and sends confirmation to the e-mail address of the customer as stated in the order. A distance agreement is subject to the applicable legislation of the Republic of Latvia. A distance agreement remains in force until it is executed in full.
  1. Before concluding an agreement in the E-shop, the customer must become acquainted with these Terms. By concluding a transaction, the customer represents that, prior to concluding the distance agreement, they have become acquainted with the Terms and will observe them, and represents further that they consent to the Terms without objections.

Payment Procedure

  1. By confirming an order in the E-shop, the customer consents to the stated amount of payment for the transaction, and to the procedure of payment.
  2. Payments are supported by the Montonio payment platform (Montonio Finance UAB, address: Kai 1, Tallinn, Estonia).
  1. Payment for a transaction may be made only using the cashless payment options available on the E-shop.
  1. The Timo Murene E-shop may refrain from a transaction by notifying the customer via e-mail and issuing a refund within 10 business days if, during the period from confirmation of the order and receipt of payment for the transaction, the chosen goods are no longer available, or if processing of an order made in the E-shop is impossible for technical reasons.
  1. The date on which a payment made by the customer is received on the E-shop account is deemed to be the payment date.
  1. The price stated in the E-shop includes the applicable VAT rate.

Order Placement and Delivery

  1. Confirmation of payment as sent by a third party (e.g. a payment service provider) to the customer’s e-mail address is not considered confirmation in the interpretation of these Terms, and does not confirm the conclusion of a distance agreement.
  1. The customer must verify the order information sent to them in the confirmation e-mail. If some information is inconsistent, the customer immediately notifies the Timo Murene E-shop using the e-mail address of the E-shop: info@timomurene.eu.
  1. The customer must be available at the e-mail address and/or phone number stated in the order to accommodate arrangements regarding delivery details (time and location) with the delivery service provider (courier).
  1. Delivery of goods is provided with the mediation of DPD.
  1. Delivery of products is considered completed and the order (distance agreement) is considered executed if the ordered goods are delivered to the customer at the time and place approved by them. If, at the time of accepting the products, the customer identifies damage to or flaws in the products, the customer does not accept the product and notifies the E-shop via e-mail: at info@timomurene.eu.

Obligations of the Parties and Miscellaneous Provisions

  1. The customer is responsible for providing accurate and comprehensive information while placing the order and making the relevant payment.
  2. Disputes and disagreements are resolved by negotiating. If disputes or disagreements cannot be resolved by negotiating, the customer may indicate their objections in a written application submitted to the Bank of Latvia, sent by mail to the address Rīga, Grēdu iela 1-99, LV-1019, Latvija, or by e-mail to the address info@timomurene.eu. SIA RONAVI provides a response to the customer’s application within no more than 10 (ten) business days.
  3. If the parties are unable to achieve consensus on resolving a dispute, the dispute is considered in accordance with this arrangement.
  4. The customer consents to the processing of their Personal Data as stated in the order and/or obtained during use of the E-shop, for the purposes of executing the order (distance agreement), including the transmission and data to third parties to ensure delivery, to process payments, and to establish customer databases and statistics.
  5. By making purchases in the E-shop, the customer may consent to notifications regarding goods offered by Timo Murene being sent to the customer’s stated e-mail address or via text message to their mobile phone number. The customer may unsubscribe from further notifications regarding goods offered by Timo Murene in the E-shop.
  6. The E-shop uses cookies. By using the website, the customer consents to the use of cookies for performance and/or analytical purposes.
  7. For communication with the customer, the E-shop uses the e-mail address and/or mobile phone number stated by the customer at the time of placing an order.
  8. The images of goods provided in the E-shop are provided for reference only, and their actual appearance may differ from the images provided in the E-shop.

Exercise of the Right of Withdrawal

  1. In a purchase transaction, a customer (except legal entities) may, within 30 (thirty) days following the date of receiving possession of the goods (receipt of goods from the courier), exercise their right of withdrawal and withdraw from the distance agreement.
  2. Before the expiration of the term of eligibility for the right of withdrawal, the customer notifies the Timo Murene E-shop of their decision to withdraw from the distance agreement by submitting a withdrawal form to the e-mail address info@timomurene.eu. It should indicate contact information (name, surname, address, e-mail address, phone number), transaction details (transaction ID), payment documents (invoice/bank statement) and clarifications (reasons).
  3. Due to concerns regarding hygiene, goods may only be sent back in initial condition, intact and undamaged, in their original packaging.
  4. The customer covers all costs pertinent to returning the goods.
  5. The Timo Murene E-shop may evaluate the condition of returned goods. Upon concluding that the customer has failed to observe the provisions stated in clause 26, the E-shop reserves the right to withhold payment received for the goods.
  6. Within 14 (fourteen) days following the date of receipt of information regarding the decision of the customer to withdraw from the distance agreement, the E-shop refunds the price of the goods to the customer or notifies them about its decision to withhold the refund, in electronic format. The Timo Murene E-shop refunds amounts using the same means of payment as those used by the customer. The Timo Murene E-shop does not refund amounts incurred by the customer pertaining to transaction costs (e.g. the fee collected by a credit institution for servicing a payment) which the customer has paid to a service provider for the means of payment chosen by the customer.
